Privacy Policy

Policy Statement
Knowzy values and respects the privacy of all people, including those who access and use the Knowzy notetaker and website and those who engage with our business. We recognize the importance of protecting personal data and we build systems that safeguard data, including limiting the information we collect and maintain. We will protect individuals’ information through compliance with this policy and by collecting and using data only as reasonably necessary to fulfill the purposes described in this policy.
Questions About this Policy
All individuals should read this policy carefully to understand the practices Knowzy follows regarding personal information. If any individual has any questions about this policy, or if an individual believes the individual’s privacy has been compromised in the course of using the Knowzy notetaker or Knowzy website, please contact Knowzy’s designated agent at: support@getknowzy.com.
Scope of this Policy
This policy describes the types of information we may collect from, or about, individuals and how we collect, use, maintain, protect and disclose that information. Specifically, it applies to information we collect within and while using the Knowzy tools (defined below); in email, text and other electronic messages between you and Knowzy; while you engage with our business; and from any Institution (defined below) that has subscribed to the Knowzy notetaker on your behalf.
- The terms “user(s)” “User” or “you” or “individuals” mean and refer to you, the end user, who has accessed the Knowzy website, and/or is authorized to access and use the Knowzy platform, all in accordance with the terms of service
- The term Business User means individuals who engage with our business, such as the identity of administrators at Institutions (“Business Users”).
- The term “Institution” means and refers to a school district, school, institution of higher education, business, professional organization or other third party.
- The term “Knowzy notetaker” refers to the software platform.
- The term “Knowzy website” refers to the website located at: https://getknowzy.com.
- The term “Knowzy tools” refer to both the Knowzy notetaker and Knowzy website.
Use of the Knowzy notetaker is subject to the terms and conditions of use found here: https://getknowzy.com/knowzy-terms-of-service/. We may build, maintain and offer other online and digital platforms, software, tools, mobile applications and other formats in the future. If we do, this policy will apply to those formats.
Age Restrictions
Users who are eighteen and older may register, access and use the Knowzy notetaker without consent from a third party, like a parent; provided, that in some cases, an Institution must authorize Users to use the platform. Thus, may Knowzy collect, maintain or disclose personal information from people over the age of eighteen in accordance with this policy.
For users between the ages of 13 and 17, we may require verifiable parental, guardian or Institution consent prior to collecting, using, or disclosing personal data, where required by applicable laws or institutional policies.
Knowzy does not knowingly collect, maintain or disclose personal information from or about people under the age of thirteen and all Users under the age of thirteen are prohibited from using the Knowzy notetaker. Therefore, If you are under 13, do not use the Knowzy notetaker or any of its features; do not register; and do not provide any information about yourself to us. If we learn we have collected or received personal information from a child under 13 without verification of parental consent, we will delete that information. If you believe we might have any information from or about a child under 13, please contact us at support@getknowzy.com. In the future, we may provide certain features, functions or offerings to students who are under 13 (such as middle school students in 6th and 7th grade who are 11 and 12 respectively). If we do extend offerings to these students, we will provide a mechanism to obtain and track parental, guardian or Institution consent, as applicable.
Geographical Restrictions
Users outside of the United States are prohibited from accessing or using the Knowzy tools and Knowzy tools are designed for use solely in the United States. Therefore, Knowzy does not knowingly collect, maintain or disclose personal information from people outside of the United States or from residents of countries other than the United States. In the event Knowzy learns that a user has accessed and used the Knowzy tools outside of the United States, Knowzy will take reasonable corrective action, such as deleting the data. Knowzy may expand beyond the United States in the future and, if so, the terms at the end of this policy will apply to the collection and transfer of data outside of the United States.
When and How Personal Information Is Collected
Knowzy does not collect any personally identifiable information when Users interact with the Knowzy website. Knowzy collects limited personally identifiable information when Users interact with the Knowzy notetaker and when Users engage with our business. Specifically, Knowzy collects email addresses in connection with the Knowzy notetaker and those email addresses are stored by our identity provider for the purpose of verifying the User and permitting User to access the Knowzy notetaker. Knowzy does not collect, maintain or store any other personal information about individuals in connection with the Knowzy tools, even when Users register to use the notetaker. Knowzy may collect, maintain or store personal information about Business Users.
Although Knowzy does not intentionally collect personally identifiable information in connection with the Knowzy tools, it is possible that Knowzy will receive personally identifiable information in specific situations, such as when Institutions provide the information; when Knowzy renders support to users; in connection with billing and invoicing, during a pilot program (particularly while collecting feedback about the use of the Knowzy notetaker) and in connection with operating, supporting other aspects of the Knowzy tools.
For example, in the event an individual seeks customer support (regarding a problem the individual experiences with the Knowzy notetaker), the individual may be asked to provide contact information, a summary of the problem, and any other documentation, screenshots or information that would be helpful in resolving the issue. Personally identifiable information collected during the customer support process will be subject to this policy, whether the individual is a technical contact, opens a support ticket, speaks to a Knowzy representative directly or otherwise engages with Knowzy’s support team.
Information That Is and Is Not Collected
Type of Personal Information Collected at Registration
As described above, Knowzy only collects a person’s email address when registering to use the Knowzy notetaker.
Type of Information Collected While Using the Knowzy Notetaker
Knowzy collects generalized non-specific information while Users engage with the Knowzy notetaker, such as text, content, notes, presentations, transcriptions, images, queries and other materials. This information does not constitute personally identifiable information as it cannot be used to either directly or indirectly distinguish or trace an individual’s identity. Knowzy may use this information to render the Knowzy services, to operate the Knowzy notetaker and for other business purposes.
As detailed in the terms of service, the user providing the information represents that it has all right and license to provide all information to Knowzy and permits Knowzy to use same in accordance.
Login Details
Login details for each individual, such as a password, are the responsibility of that individual. The individual is fully accountable for any use or misuse of the Knowzy notetaker and the personally identifiable information contained therein as a result of sharing or providing login details to someone else. Knowzy recommends that individuals change their passwords frequently and at least every six months.
Type of Personal Information Not Collected at Registration
Knowzy does not collect the following types of personally identifiable information, and none are required for the individual to create a profile or account:
- name and username
- phone number
- birthdate
- location (such as state in the US and other elements of location)
- user ID
Additional Type of Personal Information Not Collected
- Knowzy does not collect social security numbers, driver’s license numbers, passport numbers, state identification card numbers, immigration status, genetic data and union membership information.
- Knowzy does not collect or track information about individuals when individuals leave the Knowzy notetaker and access and use a third-party service.
- Knowzy does not collect or store data by household.
- Knowzy does not collect medical records, individually identifiable health information or any other information relating to past, present or future physical or mental health conditions of any individual. Similarly, Knowzy does not collect educational information or student records.
Information Provided by Institutions, In Connection with Pilot Programs and Other Matters
Institutions, Users, Business Users and others may provide Knowzy with personally identifiable information about Users (and Business Users), in the manner and at the time as described above. Depending on the circumstance, the information may include:
- name
- birthdate
- gender
- ethnicity
- location, address
- user ID
- phone number
- pronouns, gender identity
- classroom, student status and other educational information
- other information requested and/or the individual provides
As detailed in the terms of service, to the extent any or all of the above information is supplied to Knowzy, the individual providing the information represents that it has all right and license to provide all information to Knowzy and permits Knowzy to use same in accordance with this policy.
Aggregated Information / Anonymized Data
Knowzy may use anonymous, statistical or aggregated information (including anonymous location information), in a form that does not enable the identification of a specific user, to properly operate the Knowzy notetaker, to improve the quality of the Knowzy notetaker, to enhance the individual’s experience, to create new services and features, to change or cancel existing content or service, and for further internal, business and statistical purposes. Although we describe how we use aggregated information, aggregated and/or anonymized data does not constitute personal data and is not subject to this privacy policy. From time to time, Knowzy may release non-personally identifying information in the aggregate, such as by publishing a report on trends revealed through the usage of the Knowzy notetaker.
Artificial Intelligence; Automated Decision Making
The Knowzy notetaker does not contain any automated decision making, such as an electronic process to approve or reject a user from accessing content. However, the Knowzy notetaker uses artificial intelligence to process information as maybe necessary to render content (including to make content and resource recommendations based upon user input and search terms) and to enable individuals to efficiently use the Knowzy notetaker (including to take, store, analyze, combine and retrieve notes).
Use of Information Collected
As described herein, Knowzy generally does not collect, maintain or process personally identifiable information in connection with the Knowzy tools. Rather, Knowzy uses tokens, which are securely stored, such as through cryptographic means, so they cannot be reverse-engineered and the personal information may not be obtained. However, to the extent Knowzy collects personally identifiable information – at the times and in the manners described herein – Knowzy uses such information, to support the Knowzy tools and its business. Specifically, Knowzy may use and process Users’ information, using different technologies for the following purposes:
- To operate the Knowzy tools and to fulfill the purpose for which you provide the information
- To conduct the business of Knowzy and to fulfill and follow and enforce this privacy policy and the terms and conditions
- To help improve the reliability of the Knowzy tools
- To customize and personalize the user experience, to tailor content, to deliver relevant information, and for other usage within the Knowzy notetaker
- To communicate with individuals about the Knowzy tools, including for example sending individuals technical notices, updates, security alerts, and administrative messages (and to contact individuals when Knowzy reasonably believes it necessary to do so)
- To troubleshoot and resolve technical issues, to respond to requests for assistance, to repair and improve the Knowzy notetaker and to ensure the Knowzy tools are working as intended, such as tracking outages (Only where necessary, we may share information with a third-party for the purpose of responding to support-related requests, such as with the payment processor, when applicable)
- To send updates, notices, announcements and additional information related to the Knowzy notetaker (including through push notifications, where applicable)
- To comply with, or as required by, any applicable law and to assist law enforcement agencies (if legally mandated, Knowzy’s opinion) or in response to legal processes and law enforcement requests and as necessary or appropriate, in Knowzy’s view
- To take any action in any case of dispute, or legal proceeding of any kind between an individual and Knowzy, or between an individual and other users (to the extent Knowzy may become involved in such disputes as described in the terms and conditions)
- In the future, Knowzy may develop tools that enable it to use the data to identify and prevent fraud, misappropriation, infringement, identity theft and other illegal activities and misuse of the Knowzy notetaker and to protect against harm to the rights, property or safety of Knowzy, users (and other individuals)
- To identify trends and improve Knowzy notetaker and to develop new products, features and technologies that benefit users (and possibly to offer third-party products)
- To conduct research (subject to the limitations described in the paragraph entitled, “Research Information”)
- To create aggregated and/or anonymous data (where such data does not enable the identification of a specific user) and provide that anonymized data to third parties to assist Knowzy in achieving its business objectives as described in this policy
- To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of Knowzy’s assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by Knowzy about the Knowzy notetaker users is among the assets transferred.
- For any other purpose disclosed by us when you provide the information
- With your consent
Knowzy does not provide any personal information to third parties including, but not limited to, those who share or rent information for direct marketing purposes; provided, however, we may share information with payment processors (as described below) and similar technology providers for the purpose of facilitating the provision and operation of the Knowzy notetaker (such as the authenticator). Knowzy does not provide the personal information to third parties who share or rent information for direct marketing purposes.
Unless and until Knowzy receives notice of an individual’s request to delete its account (and subject to the retention requirements) or the data is deleted in accordance with any automatic data deletion process, whichever is first, all individuals hereby consent to the use of individual information in accordance with this policy.
Research Information
Some users will take part in research studies with or on behalf of Knowzy. For each such user, additional or different rules pertaining to the collection, maintenance and usage of data may apply. (For example, the data collected about research subjects is not subject to the automatic data deletion procedures.) All use of data from research subjects will be in accordance with the applicable research study materials, including the relevant consent forms, and Institutional Review Board protocols.
Financial Information
As described in the terms and conditions, Knowzy may charge Users a usage fee, a pilot fee, or another transaction fee involving the purchase of a subscription to use the Knowzy notetaker and the payment for such fees will be completed through the use of a third-party payment processor selected by Knowzy. Users must submit a valid payment card (debit, credit), bank account information, routing number, and other information as may be required by the applicable third-party payment processor. Knowzy does not operate, own, or control payment processor; thus, all financial transactions, including the use of the User’s payment card and transfers of funds to and from the User’s bank account are governed by the applicable platform store and/or the payment processor’s policies (including privacy policies), procedures and agreements with the user, as applicable. Knowzy may keep limited payment information in its database, such as a customer ID, to enable the third-party processor to communicate with Knowzy about whether a subscription is active, payments are made, and other similar payment terms, such as payment history.
General (Non Personal) Information Collected
Knowzy may use a third party, such as Google Analytics to collect information about each individual’s activity while using the Knowzy tools. Activity information does not include personally identifiable information and it may be stored in a tracking database (such as in Google Analytics). Knowzy may use activity information for analytics and to measure or understand how the Knowzy tools are used and how to improve the Knowzy notetaker, including for example, to customize the software platform for different user segments, implement new ideas, uncover insights and/or better understand individual’s usage to support and retain users.`
Web Site, Specifically.
We do collect non-personally identifying information of the sort that web browsers and servers typically make available, such as the browser type, operating system, language preference, referring site (including country location), and the date and time of each visitor request. As you navigate through and interact with the website, we may use automatic data collection technologies to collect certain information about your equipment, browsing actions, and patterns, including: (i) details of your visits to the website, including traffic data, logs, and other communication data and the resources that you access and use on the website; and (ii) the individual’s session length (how long an individual uses the website), session clicks or usage flows, taps, scrolling information and other similar analytics. Knowzy does not collect or track information about Users when Users leave the Knowzy website and access and use a third-party service. Our purpose in collecting non-personally identifying information is to better understand how Knowzy’s visitors use its website and other Knowzy tools.
“Cookies” and Other Tracking Devices
A “cookie” is a small data file sent to a browser from a web server and stored on the user’s computer. If an individual accesses the Knowzy website using a computer, Knowzy may, use cookies for various purposes (such as to avoid re-entering a username and password each time an individual logs in), to facilitate the use of the website, to collect statistical information, to verify information, and to customize usage to an individual’s preferences and for information security purposes. Some of the cookies may expire when a session ends; other cookies may be saved on a computer’s hard drive. Individuals who do not wish to have cookies placed on their computers should set their browsers to refuse cookies before using the Knowzy website, with the drawback that certain features of the Knowzy website may not function properly without the aid of cookies. Knowzy may engage third parties to assist in analyzing our business such as Google Analytics to track and report on website traffic.
Information Security
Knowzy implements systems, platforms and procedures to secure individuals’ information, to minimize the risk of damage, theft, and loss of information. Knowzy uses commercially reasonable efforts to protect all personal information, such as in the following ways:
- Encryption – Encryption technologies protect the information by scrambling it as it is sent from one computer or device to another. Knowzy transmits all data using SSL/TSL encryption.
- System monitoring – Regularly reviewing activity logs allows Knowzy to identify potential problems. Knowzy also has systems in place to automatically block and help prevent unauthorized access to information. We also review our information collection, storage and processing practices, including physical security measures, to guard against unauthorized access to systems.
- Patches – Knowzy updates its systems at routine intervals to use current security technology.
- Limited Access – Knowzy restricts access to personal information to those people who need to know that information in order to conduct Knowzy’s business.
- Security Measures for Storage – Knowzy uses only those hosting providers that meet security requirements necessary to protect the information.
Knowzy uses commercially reasonable efforts to document these information security procedures in applicable policies.
These measures cannot provide absolute assurance. Therefore, Knowzy does not guarantee that its systems and databases will be immune from misuse, abuse, malfunction or illegal interception or access. Thus, all disclosure of information, including personal information, is “as is” and without Knowzy’s warranty, guarantee, or liability.
Data Retention
We will retain information about you (which might be solely an email address stored by our authentication provider) both while you are an active user of the Knowzy notetaker and after you cease to be an active user, unless and until you exercise the right to delete your personal information in the manner described in this policy. However, despite this general rule, Knowzy will retain information collected about Users (which may just be an email address) for as long as reasonably required to satisfy the purpose for which the information was collected, or as contractually obligated, or as required by law, whichever is longer. We may build and implement an auto delete feature in the future.
Your Rights to Change, Update, Delete Personal Information and Opt-Out
If you do not agree with this policy, do not access or use the Knowzy tools. For all individuals who have registered to access, access, or use the Knowzy notetaker, but do not agree with this policy and wish to change, update or delete personal information or opt-out, follow the procedures set forth below (all users are citizens of the United States and to the extent the Knowzy notetaker becomes available for non-US citizens in the future, the following may not apply):
Delete Your Account
If an individual wishes to delete the individual’s account and/or the information held by Knowzy, the individual must send an email to the designated agent at support@getknowzy.com stating that the individual wishes to delete an account (or the information) and cease use of the Knowzy notetaker. Upon receipt of such a request, Knowzy will use reasonable efforts to delete such information, however information may not be deleted immediately from back-up systems. Knowzy will begin a process designed to safely and fully delete the data from storage systems, databases and other infrastructure used in connection with the Knowzy notetaker. This process may take several days from the time of commencing the deletion process. As with any deletion process, things like routine maintenance, unexpected outages, bugs, or failures in our protocols may cause delays in the processes and time frames defined in this policy.
Delete the Software Platform
If you no longer wish to use the Knowzy notetaker, you may delete the software platform and deactivate your use of the Knowzy notetaker. Deactivating your account does not delete your information. Your information will remain in the systems of Knowzy unless and until you submit a request to delete your account as described above or upon the automatic data deletion process, if any.
Access, Modify and Update your Information
You have the ability to access and update certain information about yourself in connection with the Knowzy notetaker or that may be stored and maintained about Business Users. To do so, such as to update your email address, send an email to support@getknowzy.com with the nature, scope and purpose of the update.
Request That We Stop Using Your Information: In some cases, you may ask Knowzy to stop accessing, storing, using and otherwise processing your information where you believe we don’t have the rights to do so. If you believe an account was created for you without your permission or you are no longer an active user, you can request to delete your account as described above. If you provided consent to use your information for a limited purpose, you can withdraw that consent by sending notice to the designated agent at support@getknowzy.com, but this will not affect any prior processing of your personal information. When you make such requests, we may need time to investigate the basis of your request. If there is a dispute as to whether we have the right to continue using your information, we will restrict any further use of your information until the dispute is resolved.
Understanding What Data Is Being Processed
If you would like to understand or confirm what personal data is being processed about you, please contact support@getknowzy.com and we will take commercially reasonable steps – or those required by law – to provide the applicable information or confirmation.
Turn off Cookie Controls
Within the context of the Knowzy website, you can set your browser to reject browser-based cookies and/or to adopt the “Do Not Track” feature (to the extent your browser offers it).
Opt-In and Opt-Out Of Communications
Knowzy may offer users the ability to receive promotional communications, marketing materials and updates, and to the extent such communications are provided, the Users should follow the opt-out process as described in this paragraph. Knowzy might also provide content to Users about additional features, functions, and lessons learned from the Knowzy notetaker. You can opt-out of receiving this information by clicking the unsubscribe link within each email, or if available, update your email preferences within your profile, if one exists, or contact the designated agent and request that your contact information be removed from our promotional email list. Notwithstanding the foregoing, some states require that users have the right to opt-in to particular types of communication and Knowzy will take steps to identify those states and implement the different formats, as practicable.
Data Portability
Data portability is the ability to obtain some of your information in a format you can move from one service provider to another. In the context of the Knowzy notetaker, you may request an extract of your data, and within a reasonable time within receipt of such request, we will provide you with an electronic file (or possibly a screen shot) of your basic account information. Individuals may then transfer that data to any chosen service provider.
Denying a Deletion Request
We may deny your deletion request if retaining the information is necessary for us:
- Complete the transaction for which we collected the personal information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform our contract with you
- Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities
- Debug products to identify and repair errors that impair existing intended functionality
- Exercise free speech, ensure the right of another consumer to exercise their free speech rights, or exercise another right provided for by law
- Comply with a legal obligation or the law (such as California Electronic Communications Privacy Act (Cal. Penal Code § 1546 seq.))
- Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information’s deletion may likely render impossible or seriously impair the research’s achievement, if you previously provided informed consent
- Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us
- Make other internal and lawful uses of that information that are compatible with the context in which you provided it
Changes to Our Privacy Policy
It is our policy to post any changes we make to our privacy policy here: www.getknowzy.com. If we make material changes to how we treat individuals’ information, we will place a notice within the Knowzy tools or in another easily identifiable location. The date the privacy policy was put into effect, or last revised, will remain at the top of the page. In any event, any changes to this privacy policy will be effective immediately on posting, unless otherwise stated or required by applicable law.
Assignment of Terms and Related Entities
If Knowzy organizes within a different legal structure or entity, or if Knowzy is acquired by, or merged into or with another entity, or if Knowzy enters bankruptcy, these terms shall be equally applicable to the surviving entity; provided however, that those entities agree to be bound by the provisions of this privacy policy. Therefore, we may change ownership or corporate organization while providing the Knowzy tools and if we do, we may transfer some or all of the personal information about you in connection with any merger, acquisition, sale of assets (or business line), change in ownership or control, or financing transaction.
Additional Requirements for Specific Individual States and Countries
Some states in the United States provide you with specific rights to access, modify, and delete your personal information. Some states also have rules and obligations for Knowzy to follow about how we communicate privacy-related information to you. This privacy policy is designed to comply with the various state requirements. We recognize, however, that states enact new laws, or change their laws, in the privacy area frequently.
Residents of California
The California Consumer Privacy Act (“CCPA”), as amended by the California Privacy Rights Act (“CPRA”), provides California residents with specific rights regarding their personal information. If you are a California resident, your rights are described below. If you have any questions about whether any of the following applies to you, please email us at support@getknowzy.com.
The CCPA requires a description of data practices using specific categories, which are all denoted by the section titles contained in this policy. This policy conforms to the requirements of the CCPA in the sections above by providing the following information:
- the categories of information Knowzy collects
- the sources of the information that is being collected
- why Knowzy collects data
- how Knowzy uses information
- the circumstances in which Knowzy may share information
Knowzy will not discriminate against any individual for exercising privacy rights in compliance with the CCPA.
In accordance with the CCPA, Knowzy provides all Users with the right to access information and request that Knowzy delete that information. To exercise these rights to access, review, update and delete information, as well as export and download a copy of it, follow the procedures set forth above and Users must send a verifiable request to support@getknowzy.com. If any individual has any questions related to rights under the CCPA, the individual (or an authorized agent) can also contact Knowzy at the address listed in the questions section above.
California Civil Code Section § 1798.83 permits users of the Knowzy notetaker that are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. To make such a request, please send an email to support@getknowzy.com.
You also have the right to request that we disclose certain information to you about our collection and use of your personal information in the past 12 months (including the categories, sources, and specific personal information we collected about you, our business purposes for collecting that information, the categories of third parties with whom we shared that information, and information about the sale of that information). In short, California law requires disclosure of the categories of personal information collected and shared with our affiliates over the past 12 months. Those categories, as described by the CCPA and CPRA, consist of the following:
- Identifiers, including name, email address, IP address, and an ID or number assigned to your data.
- Internet activity, including your interactions with our services and what led you to our Knowzy notetaker.
- Commercial information, including records of the products or services you have purchased.
If we have sold your personal information over the past 12 months, we will identify the categories of personal information purchased by each category of third-party recipient. AT THIS TIME COMPANY DOES NOT SELL ANY PERSONAL INFORMATION AND HAS NOT SOLD ANY SUCH INFORMATION IN THE LAST TWELVE (12) MONTHS
Only you or a person registered with the California Secretary of State that you authorize to act on your behalf, may make a verifiable consumer request related to your personal data. You may also make a verifiable consumer request on behalf of your minor child. You may only make a verifiable consumer request for access or data portability twice within a 12-month period. The verifiable consumer request must provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information (or you are an authorized representative) and it must describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.
We try to respond to a verifiable consumer request within 45 days of its receipt. If we require more time (up to 90 days), we will inform you of the reason and extension period in writing.
The CCPA defines the terms “sell” and “sale” very broadly, and although we do not intend to sell any of your data, if any of our activities fall within the definition of “sale,” as used in the CCPA, you would have the right to opt out of the sale. If you wish to exercise this right, please submit a request to support@getknowzy.com.
Should you choose to exercise any of your rights under the CCPA or CPRA, Company will not deny you any services, charge you different rates, or provide lesser quality services. However, in the future Company may elect to offer different tiers of services as allowed by applicable laws which may contain differing prices, rates, or levels of quality, which may be related to the value of personal information that we receive from you. For example, the tiers of service, with the corresponding number of queries may change.
If you are a resident of Colorado, Connecticut, Utah or Virginia and other states, you may have similar rights to know the categories of data we collect, use and disclose, as well as potential rights to request corrections or deletions of your data. To submit a request to know, correct or delete, please send an email to support@getknowzy.com We may be required to take certain steps to verify your identity before processing your request.
The body of this policy provides information pertaining to data retention, your legal rights (including the right to access, correct, erase, and transfer). To the extent you further wish to object to the processing of your personal data, withdraw consent or otherwise restrict the use of your personal data, please contact support@getknowzy.com.
Residents of the European Union and the United Kingdom and
Usage in and Related to the European Economic Area
As described in the body of the privacy policy, if you live outside the US you should not access and use the Knowzy notetaker and if we learn about data submitted outside the US we will take appropriate action, such as deleting the data. However, to ensure that Knowzy complies with all laws, we believe that this policy conforms to the requirements of the General Data Protection Regulation (GDPR) by providing the information pertaining to the collection, storage, modification, deletion and use of information about citizens and residents of the European Union and the United Kingdom and for other users of the Knowzy notetaker within the EU.
The term “Personal Data” under the GDPR means any information that is related to an identified or identifiable natural person, such as a name, location data, or identification number. (Art. 4.1 GDPR). Knowzy is a data processor as used in the GDPR, which is an entity that processes data on behalf of a controller. The User is a controller as the User determines the purpose and means of collecting, maintaining and processing the data. As used in this section, the term “you” means and refers to all Users for whom the GDPR applies.
Specifically, Knowzy collects and processes information about you only where we have legal bases for doing so under applicable EU laws. This means we collect and use your information where:
- We need it to provide you the Knowzy notetaker, including to operate the Knowzy notetaker, provide customer support and personalized features and to protect the safety and security of the Knowzy notetaker;
- It satisfies a legitimate interest (which is not overridden by your data protection interests), such as for research and development, to market and promote the Knowzy notetaker and to protect our legal rights and interests;
- You give us consent to do so for a specific purpose; or
- We need to process your data to comply with a legal obligation.
If you have consented to our use of information about you for a specific purpose, you have the right to change your mind at any time, but this will not affect any processing that has already taken place.
Exercising Rights Under the GDPR
To exercise your rights to your Personal Data, please contact Knowzy through an email to support@getknowzy.com. Subject to applicable law and in exceptional circumstances only, we may charge for this service, and we will respond to reasonable requests as soon as practicable, and in any event, within the time limits prescribed by law.
Although your rights to access, modify and delete your data are set forth in the sections above, for clarity, we restate these rights here so that you can see how the terms of the GDPR apply:
- Right of access to your Personal Data (Art. 15 GDPR): You have the right to ask us for confirmation on whether we are processing your Personal Data, and access to the Personal Data and related information on that processing (e.g., the purposes of the processing, or the categories of Personal Data involved).
- Right to correction (Art. 16 GDPR): You have the right to have your Personal Data corrected if it is inaccurate and to have incomplete Personal Data about you completed, as permitted by law.
- Right to erasure (Art. 17 GDPR): You have the right to ask us to delete your Personal Data, as permitted by law. This right may be exercised among other things: (i) when your Personal Data is no longer necessary for the purposes for which it was collected or otherwise processed; (ii) when you withdraw consent on which processing is based according to Art. 6 (1) (a) or Art. 9 (2) (a) GDPR and where there is no other legal ground for processing; (iii) when you object to processing pursuant to Art. 21 (1) GDPR and there are no overriding legitimate grounds for the processing, or when you object to the processing pursuant to Art. 21 (2) GDPR; or (iv) when your Personal Data has been unlawfully processed.
- Right to restriction of processing (Art. 18 GDPR): You have the right to request the limiting of our processing under limited circumstances, including: (i) when the accuracy of your Personal Data is contested; (ii) when the processing is unlawful and you oppose the erasure of your Personal Data and request the restriction of the use of your Personal Data instead; or (iii) when you have objected to processing pursuant to Art. 21 (1) GDPR pending the verification whether the legitimate grounds of Knowzy override your grounds.
- Right to data portability (Art. 20 GDPR): You have the right to receive the Personal Data that you have provided to us, in a structured, commonly used and machine-readable format, and you have the right to transmit that information to another controller, including to have it transmitted directly, where technically feasible and as permitted by law.
- Right to object (Art. 21 GDPR): You have the right to object to our processing of your Personal Data, as permitted by law. This right is limited to processing based on Art. 6 (1) (e) or (f) GDPR, and includes profiling based on those provisions. After which, we will no longer process your Personal Data unless we can demonstrate compelling legitimate grounds for the processing that override your interests, rights and freedoms or for the establishment, exercise or defense of legal claims. Furthermore, you have the right to object at any time to processing of Personal Data for direct marketing purposes.
Transfers of Your Personal Data to Other Countries
The Personal Data Knowzy processes, and all associated services and systems, including registration, are typically housed on servers in the United States. If you are located outside of the United States, please be aware that Personal Data we collect will be processed and stored in the United States (the data protection and privacy laws in the United States may offer a lower level of protections than in your country/region).
In order to use the Knowzy notetaker, we may require you to agree to the transfer, storage, and/or processing of your Personal Data in the United States. In other situations where Personal Data is transferred outside of the European Economic Area or the United Kingdom, Knowzy leverages other mechanisms for international data transfer including the European Commission-approved standard contractual clauses and consent. You have the right to request a copy of the applicable measure or further information by contacting us.
How we may disclose your Personal Data
The GDPR and national laws of European Union member states implementing the GDPR permit the sharing of Personal Data relating to users who are residents of the European Economic Area with third parties only under certain circumstances. If you reside in the European Economic Area, we will only share your Personal Data as described in this policy if we are permitted to do so under applicable European and national data protection laws and regulations.
Legal Basis for Processing Under the GDPR
When you register for an account or interact with the Knowzy notetaker, such processing is necessary for the performance of the Knowzy notetaker (Art. 6 (1) (b) GDPR).
- For sensitive data as defined in the GDPR, we process such data on the basis of your prior consent (Art. 9(2)(a) GDPR).
- For non-sensitive Personal Data which we need in order to perform the Knowzy notetaker, such processing is necessary for the performance of the Knowzy notetaker (Art. 6 (1) (b) GDPR).
- With regard to other non-sensitive Personal Data, we process such data on the basis of our legitimate interest (Art. 6 (1) (f) GDPR), and our legitimate interest is to review, offer, maintain, provide, improve and enhance the Knowzy notetaker.
- When we leverage and/or collect cookies, device IDs, data from the environment, and other tracking technologies, we process your Personal Data on the basis of your consent (Art. 6 (1) (a) GDPR), and based on our legitimate interest, Art. 6 (1) (f) GDPR, to the extent permitted by applicable law.
- When we aggregate or centralize data or conduct analytics such processing is either necessary for the performance of the Knowzy notetaker (Art. 6 (1) (b) GDPR) or we process such data on the basis of our legitimate interest (Art. 6 (1) (f) GDPR), and our legitimate interest is to provide you with better or customized Service.
- When we process or share Personal Data in the event of an actual or contemplated sale, or investigate suspected illegal or wrongful activity, we process such data for our legitimate interest in offering, maintaining, and providing, the Knowzy notetaker and complying with other laws, Art. 6 (1) (f) GDPR).
Right to Lodge a Complaint Before the Data Protection Authority
In the event you have a complaint that cannot be resolved by, or addressed to, Knowzy, you may lodge a complaint with a competent data protection supervisory authority. Specifically, you may wish to file a complaint with the EU Member State where you reside, work or the place of the alleged infringement. You have the right to do so if you consider that the processing of Personal Data relating to you infringes applicable data protection laws.
Accessibility Standards
This privacy policy may be available in a format in the future that complies with the WCAG 2.1 AA Web Accessibility Initiative, which brings together people from disability organizations, industry, research labs and government, to develop guidelines to help make the Web accessible to people with cognitive, auditory, physical, speech, neurological, and visual differences. Presently, the Knowzy notetaker and the web site implement numerous technology tools to address various requirements for compliance with certain disability standards.
